Pomelo Points Program Agreement

This agreement governs the Pomelo Points Program between you and Pomelo. By redeeming Pomelo Rewards Points or using any program feature, you accept the terms of this agreement. This version replaces all previous versions. We reserve the right to modify the Program at any time, including adding new terms, conditions, disclosures, or agreements, which will become part of this agreement. For certain changes, we'll provide at least 30 days' notice, or longer if required by law, as specified in the Notice of Changes. We may temporarily restrict your ability to earn points, use earned points, or access program features.
Definitions
• Program means this Pomelo Points Program.
• Points Program Agreement and Agreement mean this agreement.
• Account and Card means the Pomelo Mastercard account linked to this Program.
• Bank means Coastal Community Bank, Member FDIC, which issues the Pomelo Mastercard pursuant to a license from Mastercard International.
• Pomelo means Pomelo International, Inc., a technology services provider and administrator of the Pomelo Mastercard.
• We, us, and our mean Pomelo, the Bank, and their service providers.
• You and your mean the person responsible for the Account.
• Rewards Points and Points mean the rewards you earn under the Program.
• Purchases are defined in the Earning Points section of this document.
• Misuse means the improper use of the Program or Card in a manner inconsistent with the terms and conditions you've agreed to, including this Rewards Program Agreement, the Pomelo Account Cardholder Agreement, or the terms and conditions of a third-party merchant or service provider program, through which points may be used or transferred under this Program.
Notice of Changes
We will provide at least 30 days' notice (or longer if required by law) for the following types of changes to the Program or Rewards Program Agreement:
• Adding or increasing Program fees
• Decreasing the Points earning rate
• Limiting or reducing the number of Points you can earn
• Restricting the ways Points can be used
• Reducing the value of Points
• Canceling the Program entirely
Notifications requiring at least 30 days notice will be sent at our discretion via email, the Pomelo App, or Pomelo.com. For other changes to the Program or Agreement, we'll post an updated version of this agreement when you log in to pomelo.com/rewards. Without prior notice, we may change specific redemption options, such as product or experience availability. You acknowledge and agree that we may make these changes at any time and do not guarantee the future availability of specific rewards. You can view current rewards options by logging in to pomelo.com/rewards.
Earning Points
You'll earn Points on remittances through the Pomelo App and purchases of products and services made with your Pomelo Card, including purchases by an authorized user, if supported, minus any returns or refunds. The following transactions, however, do not qualify for Points: (a) balance transfers; (b) cash advances or cash-like transactions, except remittances through the Pomelo App; (c) traveler's checks, foreign currency, money orders, or wire transfers, except remittances through the Pomelo App; (d) lottery tickets, casino chips, race track bets, or similar gambling transactions; (e) checks that access your Account; (f) interest charges; (g) unauthorized or fraudulent charges; and (h) fees, including late fees.
Points are earned when a transaction is settled , minus any returns or refunds. If returns or refunds exceed the points earned, your Point balance may become negative. You can view earned Points at pomelo.com/rewards, and we may offer additional ways to track points, such as through the Pomelo App or your monthly Account statement.
You'll earn:
• 2 points for each $1 spent with your Pomelo Mastercard, including remittances through the Pomelo App. You may see “2X points” in marketing materials to refer to the 2 points you earn for each $1 spent using your Pomelo Mastercard.
• 1 point for each $1 transferred using a debit source of funding.
• Bonus Points. We may offer you ways to earn Bonus Points through the Program. You'll learn more about the number of Bonus Points you can earn, the duration of the offer and expiration date, if any, and any other terms at the time of the offer. The additional terms will be part of this agreement. The natural expiration of a limited-time Bonus Points offer is not a modification to the Program that requires notification.
How you can use your points
You can redeem your points for any available rewards, including products or services offered through the Program or by third parties. Additional options to use your points, such as through Pomelo or other providers, may also be made available. You are responsible for managing your points, including use by authorized users. Redemption may be subject to minimum or maximum point requirements, and we will inform you of these, along with any additional terms, before you proceed. Once redeemed, point transactions are final and cannot be canceled unless stated otherwise. You are responsible for any applicable taxes, fees, surcharges, and shipping and handling charges. We are not liable for replacing lost, stolen, or damaged items, including vouchers, or for any merchant's failure to honor them.
Gift Vouchers
Points can be redeemed for gift vouchers through the Program by visiting the designated section of the App and pomelo.com/rewards. Gift vouchers are valid only at participating merchants and are subject to the issuer's terms and conditions. These terms may include expiration policies and non-usage fees and can be modified by the issuer at their sole discretion, where allowed by law.
How you could be prohibited from earning or using points
If we suspect misuse or fraudulent activity on your Account or within the Program, we may temporarily suspend your ability to earn or redeem Points. You may resume earning and redeeming Points once your Account is current or when any suspicions of misuse or fraud are resolved.
How you could lose your points
Effective July 1 2025, Points earned through your account will expire after 24 consecutive months of inactivity. Inactivity is defined as the absence of any qualifying transactions, including money transfer or card transactions.
Additional Important Information
Unless required by law, Points are not your property and hold no value until redeemed. Points cannot be transferred or moved except as specified in this Agreement and are not transferrable by law, including by inheritance, bankruptcy, or divorce. We are not responsible for any disputes you may have with authorized users of your Account regarding the Program.
Pomelo, the Bank, and its third-party providers, along with their affiliates, directors, officers, employees, agents, or contractors, make no express or implied representations or warranties, including those regarding merchantability, fitness for use, or suitability for a particular purpose. You release us, our third-party service providers, and their affiliates, directors, officers, employees, agents, and contractors from all claims related to Program use and any redemption or purchase made through the Program. You agree to indemnify and hold us, our third-party service providers, and their affiliates, directors, officers, employees, agents, and contractors harmless against any loss, damage, liability, cost, or expense (including legal fees) arising from your or an authorized user's Program use, fraud, misuse, Agreement violations, or violations of any applicable law or third-party rights.
We may assign our rights and obligations under this Agreement to a third party, who will then be entitled to any rights transferred. Merchants and third-party providers participating in the Program are independent and are neither sponsors nor co-sponsors of the Program. All trademarks, names, and logos used are with permission and are the property of their respective owners. Merchants and third-party providers participating in the Program may change without notice and are responsible for the quality and performance of their products and services. We are not liable for any aspect of products or services provided by participating merchants or third-party providers.
The Program is void where prohibited by federal, state, or local laws. This Agreement and the Program are governed by federal law and the laws of Washington, regardless of where you live or use the Program. We reserve the right to enforce this Agreement at any time and may delay enforcement without waiving our right to enforce it later. If any term of this Agreement is deemed unenforceable, the remaining terms will still apply.
Communications
We may send Program-related communications to you via any mailing or email address we have on file, or through our online services like pomelo.com or the Pomelo App. Please notify us promptly of any changes to your contact information by using the details on your Card's monthly statement or by calling the number on the back of your Card.
